유럽인권재판소가 19일 북송 위기에 처한 북한 주민들이 러시아를 상대로 제기한 소송에 대한 판결을 내릴 예정입니다. 이들은 북한으로 송환될 경우 고문이나 처형을 당할 위험이 있다고 호소하고 있습니다. 안준호 기자가 보도합니다.

유럽인권재판소(ECHR)가 오는 19일 북한으로의 송환을 거부하고 러시아에 합법적으로 잔류하기를 원하는 북한 국적자 3명이 추방 및 강제 퇴거 명령을 내린 러시아 정부를 상대로 낸 소송에 대해 판결한다고 밝혔습니다.

유럽인권재판소는 14일 보도자료에서 이같이 밝히며 북한 국적자 K.J.와 C.C.는 지난 2020년 러시아 영해에서 불법적으로 고기잡이를 한 혐의로 유죄 판결을 받고 징역형을 선고받았다고 밝혔습니다.

또한 2019년 러시아 블라디보스토크에서 유학 중이던 또 다른 북한 국적자 S.K.는 1년 동안의 학업 후 북한으로 돌아가지 않기로 결정했다고 설명했습니다.

S.K.는 그후 구금에 관한 기록 없이 구금됐다고 주장했다고 유럽인권재판소는 밝혔습니다.

[ECHR] “The applicants are two nationals of the Democratic People’s Republic of Korea (DPRK), K.J. and C.C., and the Institute for Human Rights, a non-governmental organisation representing S.K., another DPRK national. K.J. and C.C. were convicted of illegally fishing in Russian territorial waters in 2020 and were given prison sentences. S.K. was a student in Vladivostok in 2019 and after a year’s study decided not to go back to the Democratic People’s Republic of Korea(DPRK). He alleges that he was subsequently detained without a record of that detention. The case concerns their ordered removal to the DPRK.”

특히 S.K.는 납치돼 제대로 된 법적 절차를 거치지 않고 러시아에서 북한 관리에게 넘겨졌다고 주장했습니다.

유럽인권재판소에 따르면 이들 3명은 모두 유효한 신분증 없이 난민 지위나 임시 망명, 또는 신원 확인 절차를 신청해 러시아에서 합법적 지위를 얻고자 했습니다.

그러나 러시아 당국은 이들에 대해 추방 및 행정적 강제 퇴거 명령을 내렸고, 이들은 추방 때까지 구금된 상태라고 유럽인권재판소는 설명했습니다.

[ECHR] “All lacking valid identification documents, they were trying to regularize their legal status in Russia by applying for refugee status, temporary asylum and/or identification procedure. In respect of the applicants in cases nos. 27584/20 and 17085/21 deportation and administrative removal orders were issued by the domestic authorities. The applicants in these cases (K.J., C.C. and Z.K.) remain in detention pending their removal since 24 January 2020, 26 February 2020 and 20 March 2021 respectively. The applicant in case no. 39768/20 was allegedly abducted and rendered to North Korean officials in Russia bypassing any legal procedure.”

유럽인권재판소는 앞서 지난 2020년 각각 잠정 조치를 적용해 재판이 진행되는 동안 신청인들을 추방해서는 안 된다고 러시아 정부에 지시했습니다. 재판소는 또 신청인들의 익명을 보장하기로 결정했습니다.

[ECHR] “On 7 July 2020, 10 September 2020 and 1 April 2021 the Court applied interim measures in the cases nos. 27584/20, 39768/20 and 17085/21 respectively and indicated to the Government that the applicants should not be removed for the duration of the proceedings before the Court. The Court further decided to give priority to the applications and grant anonymity and confidentiality to the applicants.”

유럽인권재판소는 “이들은 북한으로 송환될 경우 고문이나 처형에 직면할 것이며, 이런 우려에 대한 효과적인 구제 수단이 없다고 호소하고 있다”고 밝혔습니다.

[ECHR] “The applicants complain that if removed to the DPRK they will face torture and death and that they do not have an effective remedy for these complaints.”

유엔 난민협약은 “생명이나 자유가 위협받을 우려가 있는 영역의 국경으로 난민을 추방하거나 송환해서는 안 된다”고 규정하고 있습니다.

유엔 고문방지협약 또한 “어떤 당사국도 고문을 당할 위험이 있다고 믿을 만한 상당한 근거가 있는 다른 나라로 개인을 추방∙송환∙인도해서는 안 된다”고 명시하고 있습니다.

프랑스 스트라스부르에 있는 유럽인권재판소는 유럽인권조약에 근거해 1959년 설립된 국제법원입니다.

지난 1998년 유럽인권조약을 비준한 러시아는 이 재판소의 판결에 따를 의무가 있습니다.

러시아에는 불법 조업 혐의로 구금됐던 북한 선원이나 북한 유학생 가운데 북한으로 돌아가기를 거부하는 이가 적지 않은 것으로 알려졌습니다.

앞서 유럽인권재판소는 지난 2017년 러시아에서 강제 북송 위기에 있던 최명복 씨에 대해 강제 송환 금지 결정을 내린 바 있습니다.
