서울에 있는 북한인권 동지 팀 피터스 씨가 어제 이-메일로 다음과 같은 성명서를 보내 왔습니다. 너무나 감동적인 이 편지는, 11월 7일, 서울역 광장에서 열린, “북녘 동포의 해방과 한국역사의 진로를 변화시킬 3일간 행사”에서 팀 피터스 씨가 오바마 美대통령에게 보낸 공개서한입니다. 팀 피터스 씨의 동의를 얻고, 한글로 수정 번역하여 서울로 다시 보냅니다.

존경하는 버락 오바마 대통령 각하, 

아래 서명한 저희들은 대한민국 NGO(비정부기구) 단체들과 이 문제로 걱정이 많은 駐韓 미국인들을 대표합니다. 11월 7일 오늘, 우리는 대한민국 수도 서울에서, 베를린 장벽이 무너진 20주년을 기념하기 위하여 이 자리에 모였습니다. 이 기념일은, 60년 前 韓반도 분단의 결과로 빚어진 고통과 이별이란 현실과 너무나 가까이 살고있는 우리로서는 그 의미하는 바가 매우 큽니다.  남북한의 경계선인 38線까지는 수도 서울에서 말 그대로 하루에 걸어서 갈 수있는 거리입니다.

대통령 각하, 우리는 북한주민들이 당하고 있는, 조셉 스탈린 시대의 굴라그나 독일 나치의 강제 수용소와 같은 북한의 감옥체계를 포함해서, 사상 그 유례가 없는 인권침해에 대하여 계속 슬퍼하고 있습니다. 이것은 단순한 추상이나 과장이 아닙니다; 천신만고 끝에 자유를 찾아 간신히 살아남은 20 여명의 강제수용소 생존자들이, 북한감옥에서 당한 자신들의 비참하고 가슴이 찢어지는 실상을 전해주고 있습니다. 법정에 서보지도 못한 채, 가족 3대가 이유도 모르고 사법 체형을 받는 일들이 북한전역에서 비일비재하게 벌어지고 있습니다. 기독교 신앙을 고백하거나, 일인수령 절대독재 김정일 가문의 정권을 조금이라도 비판한 사람들에게는 생체실험과 독가스 실험이 집행되기도 한다 합니다.

각하도 아시다싶이, 많은 북한주민들이 평상 사회생활에서도 미앨 일어나는 인권부재의 숨막히는 현실에서, 이웃나라 중국으로 탈출하고 있습니다. 중국은 1951년 난민보호협정에 가입서명한 국가임에도 불구하고, 지난 13년 간, 국제인권 협약의 의무를 외면하고 있습니다.  중국은 탈북자들을 북한 정보기관에 조직적으로 넘겨주는 강제북송 정책으로, 무고한 남성들, 여성들, 그리고 어린아이들까지 혹독한 조사, 고문 그리고 비참한 북한감옥으로 넘겨주는 불법을 자행하고 있습니다. 중국에서 인신매매를 당한 북한여성들이, 중국인의 아기를 임신하고 강제북송되면 북한에서는 이들에게 강제유산을 시킨다는 끔찍한 악몽같은 증언이 매일 들려옵니다. 어떻게 이런 야만적 행태가 해를 거듭해서 반복되고 있는지, 미국을 비롯한 다른 선진 민주주의 국가들로부터 한 마디 강력한 항의도 없이 이런 일이 계속 자행되고 있다는 사실이 저희로선 도저히 믿을 수가 없습니다. ‘강력한 도전’이란, 단순한 성명서나, 결의문, 또는 특사파견에 그치는 것을 뜻하는 것이 아니라, 우리가 가장 소중하게 여기는 인간의 존엄성을 그 어떤 근시안적 경제전략보다 더 상위에 둔다는 정책을 우리 정부 의 최고 책임자들이 확실히 밝혀야 합니다.

각하, 지난 2004년 말, 각하의 前任 대통령은 美연방국회에서, 그 해 10월, 만장일치로 결의통과한 북한인권법을 서명 발효 시켰었습니다. 이 법안에 대한 연방국회의 엄청난 지지와 중국에서 말못할 수난을 겪고있는 탈북자를 돕는 NGO에 대한 재정지원 규정에도 불구하고, 저희가 아는 바로는, 이 부분에 관련되어 조지 W. 부시 정부의 차기 국가예산안 중 실제로는 이 법에 마련되었던 지원예산이 하나도 포함되지 않았습니다.  현재 탈북자들이 겪고있는 엄청난 시련을 생각해 볼 때, 우리는, 美연방의회의 강한 국가적 의지 표현에도 불구하고, 美정부가 왜 침묵과 不動을 고집하는지, 그런 정책을 어떻게 정당화 할 수 있는 지, 아무리 다시 생각해도 이해할 수 없습니다. 저희는, 중국과의 비즈니스에만 관심이 있는 미국의 막강한 무역 로비단체들이 이 법안과 정책집행에 관련되어 있어서, 위기에 처한 북한주민들을 도우라고 특별지정된 이 재원의 집행을 가로막는 것이 아닌가, 많은 의심이 갑니다.

오바마 대통령의 취임으로, 우리 북한인권단체들은, 올 해 초 힐러리 클린턴 美국무장관이 중국을 방문했을 때, 탈북난민의 수난 문제를 확고하게 제기할 것이란 희망을 가졌었습니다.  하지만 이번에도 저희들은, 북경을 방문한 클린턴 美국무장관의 인권에 대한 무관심과 홀대를 지켜보면서 다시 한번 크게 실망하지 않을 수 없었습니다. 1995년 UN 제4차 여성세계회의에서 클린턴 장관이 당시 퍼스트 레이디로서 보여준 깜짝 놀랄만한 당당한 선언과 이번 중국 방문 중 그녀가 각하의 국무장관으로서 보여준 계산되고 애매한 성명들 간의 차이가 어찌나 명백히 비교가 되던지요. 우리는 클린턴 국무장관이 14년 전, 같은 장소 바로 그 북경에서 아래와 같이 선언했던 것이 진심이었던 것을 믿고 있습니다. “여성들과 어린 여자아이들이 인간들의 탐욕 때문에 성 노예로 팔려나가는 것은 인권 위반이며 이러한 성매매를 정당화 시키려고 악용된 이유들을 더 이상 용납해서는 안 될 것이다.”

분명히, 이렇게 겁없이 당당하게 여자와 어린이들의 인권에 대해 진술했던 사실이, 바로 클린턴을 美국무장관으로 선택하여 미국외교의 책임을 맡기게 된 가장 명백한 이유라고 우리는 믿었습니다. 북경에서 클린턴 장관이 이전과 같은 고발을 다시 반복했다면 얼마나 좋았겠습니까! 계속해서 모든 탈북자들을 “불법적 경제이주민”으로 일괄적 구분짓는  행위는, 곧 너무나 취약한 환경의 수십만 북한여성들과 어린 소녀들이 성노예로서 무차별하게 납치되고 팔려가게 되는 것을 내버려 두는 짓이라고 중국정부 고위관리들에게 항변할 것을 기대 했었습니다. 이러한 비극적 상황을 그저 단순한 일화(逸話)일 뿐이라고 일축하는 사람들이 있을까 보아, 이제 근 2만명이나 되는 대한민국에 정착한 탈북자들이 그 가증할 인권유린 상황을 철저히 기록해 놓았습니다. 한국의 ‘북한 데이타베이스 센터 North Korean Database Center’가 긴 세월 바로 이 작업을 끈기있게 추진해 왔습니다! 고통스러운 현실은, 70-90%의 탈북여성들이 중국에서 아무런 시민권이나 인권의 보호를 받지 못하고 있으며, 실제로 가지각색의 인신매매 현장에서 팔려나가고 있다는 것입니다.

대통령 각하, 우리는 각하께서 곧 닥아오는 중국방문 時, 중국정부 고위관리들에게, 중국內 탈북난민들의 강제북송을 즉각 중단하라는 요구를, 단호한 태도로 언급해 주시길 간곡히 요청하는 바입니다. 이것은 중국정부에게 선처(善處)를 바라는 것이 아닙니다 --- 이는 단순히, 중국정부에게 자신들이 서명 가입한 국제조약의 의무를 준수하라고 요구하는 것입니다.

그와 동시에, 우리는 각하께서 앞으로 있을 모든 북한 지도자들과의 협상에서 북한의 강제수용소에 갇힌 모든 죄수들의 끔찍한 인권유린 문제를 포함하여 줄 것을 정중히 요구합니다. 수많은 저자들과 기자들은, 2천만 북한주민들의 혹독한 인권유린상태의 포괄적이고 제일 정확한 상징을 찾아 보았습니다. 그동안 위기에 처한 북한 주민들을 도우려 10년 이상 함께 일해온 우리 몇몇 동지들은, 북한주민들을 정확히 한 마디로 묘사하는데 있어서, “국가의 노예”라는 표현밖에는 생각나지 않는다고 합니다.

마지막으로, 우리 미국인들은, 각하께서 미국의 첫 흑인 대통령임에 대해 매우 자랑스러워 하고 있습니다. 이 사실을 각하와 함께 감축하며 생각하게 되는 것은, 우리는 21세기의 노예들이 된 북한주민들의 시련을 감싸안고 희망을 주겠다는 각하의 결정에서 흘러나오는 상징적 힘과 詩的 正義를 깊이 생각하지 않을 수가 없습니다.  우리는, 하나님 아버지께서 각하를 움직이셔서 이 일을 잘 실행할 수 있게 하시기를, 단순히, 그러나 온 신명을 바쳐서 기도할 것을 약속합니다.  

이 편지를 읽어 주시고, 이 편지내용과 조속한 조치의 절대적 필요성에 대하여 고찰해 주실 것에도 감사드립니다.

Dear President Obama,

We, the undersigned, represent concerned expatriate American as well as domestic non-governmental organizations (NGO’s) from the Republic of Korea. We have gathered today, November 7th, in the city of Seoul to commemorate the 20^th anniversary of the fall of the Berlin Wall. This anniversary has great resonance with us who live in such close proximity to the pain and separation that has resulted from the division of the Korean Peninsula nearly 60 years ago. The 38^th Parallel is literally one day’s walk from the northern limit of the capital city of Seoul.

Mr. President, we continue to grieve over the extraordinary human rights violations suffered by the North Korean people, including a prison system that begs comparison to the gulags perpetrated by Josef Stalin and the concentration camps of Nazi Germany. This is not an abstraction nor hyperbole; more than 20 survivors of the gulag system have made their way to freedom to tell their heart-rending accounts of prisons in the North. Accounts of three generations of family punishment for judicial sentences that never saw the light of a courtroom abound. Human experimentation of biological and poison gas agents are at times carried out on prisoners who have dared to embrace the Christian faith or express the slightest criticism of the all-powerful Kim Jong-il family regime.

Mr. President, we continue to grieve over the extraordinary human rights violations suffered by the North Korean people, including a prison system that begs comparison to the gulags perpetrated by Josef Stalin and the concentration camps of Nazi Germany. Human experimentation of biological and poison gas agents are at times carried out on prisoners who have dared to embrace the Christian faith or express the slightest criticism of the all-powerful Kim Jong-il family regime.

Some North Korean citizens, as you know, flee out of desperation to neighboring China to escape the suffocating vacuum of human rights even in the ordinary society of their native land. China, although a signatory of the 1951 Convention for the Protection of Refugees, has for the past 13 years, turned a blind eye to the obligations of this international human rights instrument. By systematically repatriating North Korean refugees to the DPRK government security apparatus, China continues to subject innocent men, women and even children to harsh interrogation, torture, extended imprisonment. In the cases of some trafficked refugee women who are pregnant with children fathered by Chinese men, we hear a drumbeat of testimonies to the horrific nightmare of forced abortion. How such barbaric practices could continue year after year without a profound challenge from the United States of America, not to mention other mature democracies of the world, is simply beyond belief. By ‘profound challenge,’ we do not mean mere speeches, or resolutions or special envoys, but decisions at the highest level of government that indicate that our cherished ideals of human dignity transcend our short-term economic strategies.

Sir, in the waning months of 2004 your predecessor signed into law the North Korean Human Rights Act that had passed unanimously in the U.S. Congress in October of that year. Despite the overwhelming support for this piece of legislation and the authorization by Congress of resources for NGO’s to help the highly vulnerable North Korean refugees in China, actual inclusion of the authorized funding was never, to our knowledge, included in subsequent national budgets submitted by the George W. Bush Administration. Given the extraordinary plight of the North Korean refugees in particular, we cannot remotely imagine what justification could be offered for this silence and inaction in the face of an overwhelming Congressional expression of the national will to act. We deeply suspect that America’s powerful trade lobby, with extensive business interests in China, had everything to do with sidelining the initiative to appropriate these funds earmarked for aiding North Koreans in crisis.

The inauguration of your administration, Mr. President, lifted the hopes of the North Korean human rights community that, at last, the issue of the plight of North Korean refugees in China would be taken up in a robust manner by Secretary of State Clinton during her visit to China earlier this year. Suffice it to say, we were once again deeply disappointed by the seeming de-emphasis of human rights concerns expressed in Beijing by the Secretary of State. What a stark contrast we noted between Secretary Clinton’s measured and non-committal statements as a member of your Cabinet with her surprisingly bold declarations in 1995 as First Lady as she addressed the Fourth U.N. World Conference on Women held, in, of all places, the very same city of Beijing! We have every reason to believe that Secretary Clinton was sincere when she declared 14 years ago,” It is a violation of human rights when women and girls are sold into the slavery of prostitution for human greed and the kinds of reasons that are used to justify this practice should no longer be tolerated.”

Clearly, such a fearless expression of commitment to women’s and children’s rights demonstrated one very clear rationale for selecting Secretary of State Clinton to guide U.S. foreign policy in the first place! What better place than Beijing to repeat this conviction! To confront China’s senior leadership with the undeniable fact that the uninterrupted practice of a wholesale labeling of all North Korean defectors as “illegal economic migrants,” is a virtual guarantee that hundreds of thousands of North Korean women and girls will remain utterly vulnerable to human trafficking and sexual slavery in China. Lest anyone assert that such cases are merely anecdotal in nature, we dismiss such nonsense with the fact that this deplorable situation is now thoroughly documented as a result of nearly 20,000 resettled North Korean refugees in South Korea. The North Korean Database Center has been working tirelessly for years to accomplish this very task! The agonizing reality remain that 70-90% of North Korean refugee females fall prey to some form of human trafficking while living utterly devoid of any civil or human rights in China.

Mr. President, we earnestly and respectfully encourage you, during your upcoming trip to China, to speak out in an uncompromising manner to demand that the Chinese leadership immediately halt the forcible repatriation of North Korean refugees in China. This is not to request a favor---it is to simply call China to abide by obligations clearly set forth in international conventions that have been signed by the People’s Republic of China.

At the same time, we respectfully urge you to address the utter vacuum of human rights among all prisoners in the North Korean gulag system in any future negotiations with the leadership of the DPRK. Many authors and journalists have sought for an apt symbol or descriptive image to sum up the pitiful plight of the nearly 20 million citizens of North Korea. Some of us who have worked for over a decade to assist North Koreans in crisis, can think of no more blunt and accurate description than simply that the citizens of the DPRK are “slaves of the state.”

In closing, we Americans are justifiably proud, Mr. President, that you are our first African-American head of state. In celebrating that fact, we cannot help but contemplate what symbolic power, what poetic justice would flow from your decision to embrace the agony and champion the hopes of these North Korean slaves of the 21^st Century! In short, we are committed to simply, but profoundly, pray that our Heavenly Father will move you to do just that!

Thank you for your time to read this letter and consider its contents and the grave need for immediate action.
